About This Document

These Terms and Conditions (“Terms”) govern your use of the easyDacha mobile application

and related services (“Service”) provided by easyDacha C-Corp (“easyDacha,” “we,” “us,” or “our”).

By downloading, installing, or using the Service, you agree to be bound by these Terms.

If you do not agree, do not download or use the Service.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and easyDacha.


1. Eligibility
The Service is available to individuals aged 13 and older. If you are between 13 and 17, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. easyDacha does not knowingly collect personal data from children under 13. If we become aware of such collection without verifiable parental consent, we will delete that data promptly.
If a minor uses the Service without parental consent, the parent or guardian is responsible for all activity and any resulting claims.

2. Acceptable Use
You may use the Service only for lawful, personal, non-commercial gardening and planning purposes. The following rules apply:

2.1 What You May Do
  • Take screenshots or screen recordings of your own garden plans, plant lists, and care plans for personal use, social media sharing, blogging, or promotional content.
  • Share your garden content publicly on any platform — your garden is your content, and you are free to use it as you wish.

2.2 What You May Not Do
  • Use screenshots, screen recordings, or any visual or technical documentation of the Service’s user interface, navigation design, feature flow, or functionality for the purpose of developing, designing, or replicating a competing or derivative application or service.
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, UI/UX architecture, algorithms, or design logic of the Service.
  • Access or use the Service through automated means, including bots, scrapers, or crawlers.
  • Share your account credentials with any other person, or allow others to access the Service through your account.
  • Create multiple accounts to obtain additional Free Trials or circumvent access restrictions.
  • Interfere with or disrupt the Service or any infrastructure connected to it.
  • Use the Service to transmit spam, malware, or harmful code.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Use the Service in any manner that violates applicable law or regulation.
Violation of Section 2.2 is grounds for immediate account suspension or termination without notice or refund.

3. License and Use of Service
easyDacha grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes, subject to these Terms. No other rights are granted.

4. Accounts
You must provide accurate and complete account information. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. If you believe your account has been compromised, notify us immediately at [email protected]. easyDacha is not liable for any loss resulting from unauthorized use of your account.

5. User Content & Plant Submissions5.1 General User Content
You retain ownership of content you create within the Service, including garden layouts, notes, and personal data you enter (“User Content”). You grant easyDacha a limited, non-exclusive, royalty-free license to use, store, and display your User Content solely to operate and provide the Service to you. This license terminates when you delete your account, except as described in Section 5.2 or as required by law.
You must not submit User Content that: infringes third-party intellectual property rights; is unlawful, defamatory, or obscene; contains malicious code; or violates these Terms.

5.2 User-Added Plant Submissions
The Service allows you to add plants not found in the easyDacha plant library (“User-Added Plants”). Plants you add are private to your account by default and are not visible to other users.

How We May Use Your Plant Submissions

If your User-Added Plant entry — including photos and descriptions — meets our quality standards, easyDacha may select it for inclusion in the easyDacha Shared Plant Library, where it becomes available to all users of the Service.

By submitting a User-Added Plant with photos, you grant easyDacha a perpetual, worldwide, royalty-free, sublicensable license to use, reproduce, display, and distribute your plant photos and descriptions within the Service and in any future version of the Service.

This license continues even if you later delete your account, for any content that has been selected for and remains in the Shared Plant Library.

We will display this notice clearly at the point of upload within the App.


By uploading photos as part of a User-Added Plant submission, you represent and warrant that:
  • The photos are your own original work, or you have full rights to use and license them;
  • Your submission does not infringe the copyright, trademark, or other intellectual property rights of any third party;
  • You have obtained consent from any identifiable individuals appearing in your photos.
easyDacha’s plant database images are licensed from commercial stock photo providers. We do not claim ownership of third-party stock images; any user who uploads a photo they do not own assumes full legal responsibility for that upload.

5.3 Copyright Claims & Content Removal
easyDacha reserves the right to remove any User-Added Plant content — including photos — without prior notice if: (a) we receive a valid copyright infringement claim from a rights holder; (b) we determine in good faith that the content violates these Terms or applicable law.
Content removal due to a copyright claim does not entitle you to any refund or compensation. You agree to indemnify easyDacha against any claims arising from your submission of content you did not have the right to upload.

6. Intellectual Property6.1 easyDacha’s IP
easyDacha owns all rights, title, and interest in the Service, including: the app’s source code and software; the visual design, interface layout, navigation flow, and trade dress; the plant database, care plan content, and all editorial content created by easyDacha; and all trademarks, service marks, and logos. These are protected by U.S. and international copyright, trademark, and trade dress laws.
Care plans, plant care schedules, and related educational content are proprietary works of easyDacha. You may access and follow care plans within the App for your personal gardening use. You may not export, reproduce, publish, sell, or distribute care plan content outside the Service, or use it to create a competing product.

6.2 Stock Photography
Plant images in the easyDacha library are licensed from commercial stock photo providers under terms that permit use within the Service. These images remain the property of their respective rights holders and their licensors. No rights in stock imagery are transferred to you.

6.3 No Rights Transferred
Nothing in these Terms transfers any ownership of easyDacha’s intellectual property to you. Your only right is the limited license granted in Section 3.
7. Location & Weather Data
The Service may access your device location to provide localized gardening recommendations and weather forecasts. You may disable location access in your device settings; some features may then be limited.
Weather data is sourced from third-party providers for informational purposes only. easyDacha does not guarantee its accuracy and is not responsible for actions taken based on weather data displayed in the App. We do not sell your location data to third parties.

8. Subscriptions, Promotions & Payments
8.1 Free and Paid Features
easyDacha offers both free and paid features. The free tier provides limited access as described in Section 8.4. Paid features (“Full access”) require an active subscription. Current plans and pricing are displayed within the App at the time of purchase.
easyDacha reserves the right, with reasonable notice to existing subscribers, to: introduce additional subscription tiers; add, remove, or reorganize features between tiers; and modify or discontinue individual features. The inclusion of a feature in any tier does not obligate easyDacha to maintain it there indefinitely.

8.2 Subscription Plans & Pricing
easyDacha offers the following auto-renewing subscription:

  • Annual — $34.99 USD / year, equivalent to $2.91 USD / month (with 14-day free trial for new users) — saves 41% vs. monthly
  • What's Included: Smart planner with auto-spacing, personalized Full Care Plan, 2,000+ plant guides and varieties, inventory and seed management, and all premium features.
  • Free Trial: 14-day free trial for new users. No charge until the trial ends. Cancel anytime during the trial at no cost.
  • Payment: Charged to your Apple ID at confirmation of purchase (after the free trial ends, if applicable).
  • Auto-Renewal: Your subscription automatically renews at the price shown above (or the then-current price for your plan) unless you cancel at least 24 hours before the end of the current period. Your Apple ID will be charged for renewal within 24 hours prior to the end of the current period.
  • Manage or Cancel: You can manage your subscription and turn off auto-renewal in your Apple ID Account Settings at any time after purchase.

Prices may vary by region based on Apple's pricing matrix and local taxes. Current prices in your region are displayed on the subscription screen inside the App before purchase.

8.3 Beta Early-Adopter Offer — One Year Free

Your Right as an Early Adopter Users who created an easyDacha account before the date the Service was made publicly available on the Apple App Store or Google Play (“General Availability Date”) are entitled to one (1) full year of Full access at no charge (“Early Adopter Benefit”). The Early Adopter Benefit period begins on your account creation date and expires one (1) year after that date.

This is a binding commitment by easyDacha and may not be revoked or modified retroactively for qualifying users.


At the end of the Early Adopter Benefit period, your account automatically reverts to the free tier. No payment will be collected without your affirmative action to purchase a subscription. You will be notified at least 30 days before your benefit expires.
The Early Adopter Benefit is personal and non-transferable. It applies to one account per person and cannot be combined with other offers unless expressly stated.

8.4 Promotional Offers & Discounts
easyDacha may offer limited-time promotions, discount codes, referral bonuses, or other special pricing (“Promotional Offers”). Unless otherwise expressly stated in the offer:
  • Promotional Offers are valid only for the period and audience specified.
  • Promotional Offers apply to new subscriptions only and do not retroactively apply to existing active subscriptions.
  • Existing subscribers are not entitled to promotional pricing unless the offer expressly includes them.
  • easyDacha reserves the right to withdraw any Promotional Offer before it has been accepted.
  • Promotional Offers cannot be combined with other offers unless explicitly permitted.
  • Abuse of Promotional Offers, including creating multiple accounts to obtain repeated benefits, may result in account termination.
Promotional Offers do not create an expectation of continued discounted pricing after the promotional period ends.

8.5 Free Tier Access
After your Free Trial or Early Adopter Benefit expires, and if you have not subscribed, access is limited as follows:

You may upgrade to a paid subscription at any time to restore full access.

8.6 Free Trial for New Users
Users not qualifying for the Early Adopter Benefit may receive a 14-day free trial of Full access (“Free Trial”): no credit card required; account reverts to free tier after 14 days unless you subscribe; one Free Trial per account.

8.7 Subscriptions & Auto-Renewal
If you purchase a subscription:
  • Your subscription automatically renews at the end of each billing period unless cancelled before the renewal date.
  • You will be charged the applicable fee at the start of each renewal period.
  • In compliance with the California Automatic Renewal Law (Cal. Bus. & Prof. Code § 17601 et seq.) and similar state laws, we present auto-renewal terms clearly and conspicuously before you subscribe and send a reminder before annual renewals and material price changes.
  • You may cancel at any time through: Apple ID subscription settings (iOS); Google Play account settings (Android); the account settings page on our website (if subscribed via web); or by emailing [email protected].
  • Cancellation takes effect at the end of the current billing period. Full access continues until then.
  • Deleting the App does not cancel your subscription.

8.8 Price Changes
easyDacha may change subscription pricing with at least 30 days’ advance written notice to active subscribers (via email or in-app notification). Continued use after the effective date constitutes acceptance of the new price.

8.9 Payment Processing
Payments are processed through Apple In-App Purchase (iOS), Google Play Billing (Android), or Stripe (web/direct). By making a purchase, you agree to the applicable payment provider’s terms. easyDacha does not store your full payment card information.

Web / Direct — Stripe

Email [email protected] within 14 days of purchase if the Full access feature was not made available as described. Approved refunds processed within 5–10 business days.


Additional conditions: partial billing periods are not refunded; Free Trial and Early Adopter Benefit periods are not eligible for refunds; easyDacha may, in its sole and reasonable discretion, deny requests determined to be fraudulent or abusive. Nothing in this Section limits mandatory statutory refund rights.

8.11 Failed Payments
If a payment fails, we may suspend Full access until the issue is resolved. easyDacha is not responsible for Service interruptions caused by payment failures.

8.12 Taxes
Prices may not include applicable taxes. You are responsible for taxes imposed on your purchase. Where required, easyDacha or the applicable payment provider will collect and remit taxes.

8.13 EU / EEA Consumers
If you are in the EU or EEA, you have a 14-day right of withdrawal. By requesting immediate Ful access upon purchase, you expressly consent to immediate performance and acknowledge that your right of withdrawal is waived once performance has begun. This does not affect statutory rights in the event of a defective or misdescribed service.
9. Push Notifications
The Service sends push notifications to deliver gardening reminders, task alerts, and seasonal tips related to your garden plan.
  • Upon first launching the App, your device’s operating system will ask you to grant or deny notification permission.
  • You may enable or disable notifications at any time through your device’s system settings. Disabling notifications does not affect your account or subscription.
  • easyDacha will not send promotional or marketing notifications without your separate, explicit consent.
  • Notification delivery depends on your device, OS, and network. easyDacha does not guarantee delivery.
By granting notification permission, you consent to receive the messages described above. You may withdraw consent at any time by disabling notifications in your device settings.

10. AI-Generated Content & Third-Party Data10.1 AI-Assisted Content
Some content — including plant descriptions, variety information, flavor profiles, and culinary notes — has been created or refined using artificial intelligence tools. We review and edit this content, but we cannot guarantee its complete accuracy.

It is not professional horticultural, agricultural, or culinary advice.

easyDacha is not responsible for outcomes from reliance on AI-generated content.

If in doubt about a plant’s safety, edibility, or care requirements, consult a qualified professional or authoritative source.


10.2 Plant Database & Third-Party Sources
The plant database has been compiled from multiple third-party sources and subsequently reviewed and revised by easyDacha. Plant information may vary by region and climate. easyDacha does not warrant the accuracy or completeness of plant data and is not liable for gardening outcomes based on this information.

10.3 Weather Data
Weather forecasts are sourced from third-party providers. easyDacha does not control their accuracy and is not responsible for any loss or damage from reliance on weather information in the App.

11. Beta Features & Early Access
easyDacha may make features still in development available before general release (“Beta Features”).

Beta Notice

The Service is currently in a beta phase. During this period, the Service is provided at no charge to qualifying Early Adopters as described in Section 8.2.

Beta Features are provided “as is,” without warranties of any kind. They may contain bugs, errors, or incomplete functionality. We value your patience and feedback.

easyDacha reserves the right to modify, suspend, or remove any Beta Feature at any time. Participation in beta does not create entitlement to continued availability of any feature or its inclusion in any particular subscription tier upon general release.

12. Gardening & Care Plan Disclaimer
The Service provides a plant database, step-by-step care plans, and garden planning tools for informational and organizational purposes only. None of this constitutes professional horticultural, agricultural, or botanical advice.
Care plans are general step-by-step guidelines based on plant biology and the information you enter about your garden. They represent common best practices, not a prescribed treatment for your specific conditions.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, easyDacha makes no representations or warranties regarding gardening outcomes. In particular:
  • Following a care plan, task schedule, or any other recommendation in the Service does not guarantee any specific result, including plant growth, survival, yield, quality, or harvest quantity.
  • Outcomes depend on factors outside easyDacha’s control: local climate, soil composition, water supply, pests, diseases, and user execution.
  • The Service is not a substitute for advice from a qualified horticulturalist, agronomist, or gardening professional.
  • easyDacha is not liable for crop failure, property damage, physical injury, or financial loss arising from use of the Service or reliance on any care plan, plant information, or recommendation provided therein.
By using the Service, you acknowledge these limitations and assume all risks associated with your gardening activities.
13. Service Availability & Modifications
easyDacha does not guarantee that the Service will be available at all times or free from errors. The Service may be interrupted due to maintenance, technical issues, or circumstances beyond our control.
easyDacha reserves the right to modify, update, or discontinue any feature at any time. For paid subscribers, we will provide reasonable advance notice of material adverse changes. For free tier users, changes may occur without prior notice.
easyDacha is not liable for any interruption, delay, data loss, or feature removal resulting from Service unavailability or modification.

14. Account Inactivity
An account is considered inactive if there has been no login or activity for 24 consecutive months (“Inactive Account”).
Before taking any action on an Inactive Account, easyDacha will send a notification to your registered email address. If you do not respond or log in within 30 days of that notice, we may deactivate or permanently delete the Inactive Account and all associated data.
easyDacha is not liable for any loss of data or access resulting from account deactivation or deletion under this Section. Data associated with deleted Inactive Accounts will be handled in accordance with our Privacy Policy.
Active paid subscriptions will not be cancelled without prior notice solely due to inactivity; subscription fees will continue to be charged until you cancel.

15. Future Features & Community
easyDacha may introduce additional features, including social or community features such as shared garden plans, comments, or public profiles. When introduced: additional community guidelines will apply; features may be placed in any tier at easyDacha’s discretion with reasonable notice to affected subscribers.
easyDacha also reserves the right to introduce affiliate or commercial partnerships (e.g., featured products or links). Where required by FTC guidelines or applicable law, any material commercial relationship will be disclosed at the point of recommendation.

16. Export Controls & Sanctions Compliance
By using the Service, you represent and warrant that: (a) you are not located in, or a national or resident of, any country subject to a U.S. government embargo or designated as a “terrorist supporting” country; and (b) you are not listed on any U.S. government list of prohibited or restricted parties, including the OFAC Specially Designated Nationals list.
easyDacha’s payment processors independently screen transactions for sanctions compliance as required by applicable law. You bear sole responsibility for ensuring your use of the Service complies with applicable export control and sanctions laws.

17. Indemnification
To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless easyDacha and its officers, directors, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of applicable law; (d) your infringement of third-party rights; or (e) User Content or User-Added Plant content you submit, including any copyright infringement claims related to photos you upload.

18. Disclaimers of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. EASYDACHA DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
Some jurisdictions do not allow the exclusion of implied warranties; in those jurisdictions, the above exclusions apply only to the extent permitted by law.

19. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EASYDACHA’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNTS YOU PAID EASYDACHA IN THE 12 MONTHS PRECEDING THE CLAIM; OR (B) $50.00 USD.
EASYDACHA IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING CROP FAILURE, FINANCIAL LOSS FROM GARDENING ACTIVITIES, LOSS OF DATA, LOST PROFITS, OR SERVICE INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Some jurisdictions do not allow these limitations; in those jurisdictions, the above limitations apply only to the extent permitted by law. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot be excluded by law.

20. Force Majeure
easyDacha is not liable for any failure or delay in performance due to causes beyond our reasonable control, including acts of God, natural disasters, pandemics, power or internet outages, government actions, or third-party service disruptions.

21. Termination
easyDacha may suspend or terminate your access at any time, without notice, for violation of these Terms or conduct harmful to users, easyDacha, or third parties.
You may delete your account at any time through the Settings section of the App or by contacting [email protected].
Upon termination: your license to use the Service terminates immediately; Sections 5, 6, 10, 12, 17, 18, 19, and 22 survive termination.
22. Dispute Resolution & Arbitration22.1 Opt-Out Right

You Can Opt Out of Arbitration

You may opt out of this arbitration agreement by sending written notice to [email protected] within 30 days of first creating your account.

Your notice must include: your full name, the email address associated with your account, and a clear statement that you elect to opt out of binding arbitration.

Opting out does not affect your right to use the Service or any other Terms. If you do not opt out within 30 days, you agree to resolve disputes through arbitration as described in this Section.


22.2 Informal Resolution First
Before initiating any formal proceeding, you must contact easyDacha at [email protected] with a written description of the dispute, the relevant facts, and the relief sought. We will attempt to resolve the matter informally within 60 days. This step is a condition precedent to arbitration.

22.3 Binding Arbitration
If the dispute is not resolved informally, it shall be resolved by binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules. The arbitration shall take place: in Denver, Colorado; or, at your election, by video conference, telephone, or at a location in the county where you reside. The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

22.4 Small Claims Exception
Notwithstanding the above, either party may bring qualifying claims in small claims court in the jurisdiction where you reside, provided the claim remains within that court’s jurisdictional limits and is not part of a class or representative action.

22.5 Arbitration Costs
For claims not exceeding $10,000 USD, easyDacha will pay all AAA filing, administrative, and arbitrator fees. For claims exceeding $10,000, fees are allocated as provided in the AAA Consumer Arbitration Rules.

22.6 Class Action Waiver
TO THE EXTENT PERMITTED BY APPLICABLE LAW, you and easyDacha agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class or representative proceeding.

California Residents — McGill Rule Notice

Nothing in these Terms prevents you from seeking public injunctive relief in a court of law as permitted under California law (McGill v. Citibank, N.A., 2 Cal. 5th 945 (2017)).

Any claim for public injunctive relief that cannot be arbitrated will be stayed pending resolution of all arbitrable claims.


22.7 Governing Law & Venue
These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles. For any disputes not subject to arbitration (including claims for injunctive relief), you consent to the exclusive jurisdiction of the state and federal courts located in Denver, Colorado. Notwithstanding the foregoing, if you are a consumer residing outside the United States, the mandatory consumer protection laws of your country of residence may apply in addition to Colorado law, and nothing in this Section removes rights you cannot waive under those laws.

22.8 Filing Deadline
Any claim must be filed within one (1) year after it arose, regardless of any statute of limitations to the contrary. Claims not filed within this period are permanently barred.

22.9 International Users — Arbitration Exemption
If you are located in the European Union, European Economic Area (EEA), or United Kingdom, Sections 22.3 (Binding Arbitration) and 22.6 (Class Action Waiver) do not apply to you. EU/EEA/UK residents may bring disputes before the courts of their country of residence and retain all mandatory consumer protections under applicable local law. Sections 22.1, 22.2 (Informal Resolution), 22.4 (Small Claims), and 22.8 continue to apply where consistent with local law.

23. Third-Party Services & Links
The Service integrates with or links to third-party services (payment processors, weather providers, app stores). easyDacha does not control and is not responsible for third-party content, privacy practices, or accuracy. Your use of third-party services is governed by their own terms.

24. Geographic-Specific Rights
24.1 California Residents (CCPA / CPRA)
If you are a California resident, you have the following rights under the CCPA/CPRA: right to know what personal information we collect, use, and share; right to request deletion; right to correct inaccurate information; right to opt out of the sale or sharing of personal information (easyDacha does not sell personal data); right to limit use of sensitive personal information; and right to non-discrimination for exercising your rights.
Categories of personal information we may collect: account identifiers, device information, location data, usage data, transaction history, notification preferences, and User Content. To exercise your rights, contact [email protected].

24.2 EU / EEA / UK Residents
Your data rights under GDPR and UK GDPR are described in our Privacy Policy. As a consumer in the EU, EEA, or UK, the following additional terms apply:
Cooling-Off Period. Under EU Consumer Rights Directive 2011/83/EU and equivalent UK law, you have a 14-day right of withdrawal from digital service contracts. However, by activating a free trial or starting a subscription, you expressly request that the Service begins immediately. You acknowledge that once the Service has begun, your right of withdrawal is lost in accordance with Article 16(m) of the Directive. This does not affect your right to cancel a future renewal period.
Mandatory Consumer Rights. Nothing in these Terms excludes or limits rights you have under the mandatory laws of your country of residence, including rights relating to digital content and services under EU Directive 2019/770 or equivalent UK legislation.
Online Dispute Resolution. The European Commission provides an Online Dispute Resolution platform at ec.europa.eu/consumers/odr. We are not obligated to participate in ODR proceedings but you may use this platform to submit a complaint.

24.3 Australian Residents
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law (Schedule 2, Competition and Consumer Act 2010) that cannot lawfully be excluded. To the extent our liability cannot be excluded under the Australian Consumer Law, our liability is limited, at our option, to supplying the Service again or paying the cost of having the Service supplied again.

24.4 Canadian Residents
If you are a resident of Quebec, you have additional rights under Quebec's Act Respecting the Protection of Personal Information in the Private Sector (Law 25), including the right to be informed about personal information collected about you, to request access and correction, and to withdraw consent to its use. To exercise these rights, contact [email protected]. For all other Canadian residents, your rights under the federal Personal Information Protection and Electronic Documents Act (PIPEDA) are described in our Privacy Policy.

25. Feedback
Feedback, suggestions, and bug reports you submit are non-confidential and may be used by easyDacha without restriction or compensation. We especially welcome feedback during the beta phase.

26. Modifications to Terms
easyDacha may update these Terms at any time. We will notify you of material changes by updating the “Last Updated” date above and, for material changes, by sending notice through the App or to your registered email. Continued use after the effective date constitutes acceptance.
We will not retroactively modify the Early Adopter Benefit described in Section 8.2 for users who already qualify.

27. Miscellaneous
Entire Agreement. These Terms and our Privacy Policy are the entire agreement between you and easyDacha regarding the Service.
Severability. If any provision is found invalid or unenforceable, it will be modified minimally to make it enforceable; remaining provisions continue in full force.
No Waiver. Failure to enforce any right is not a waiver of that right.
Assignment. You may not assign these Terms without prior written consent. easyDacha may assign freely, including in connection with a merger, acquisition, or sale of assets.
Language. These Terms are in English. Any translation is for convenience only; the English version controls.

28. Apple-Specific Terms (Applicable Only to Apps Downloaded from the Apple App Store)
These terms apply only to your use of the easyDacha application downloaded from the Apple App Store. In the event of a conflict between this Section 28 and other provisions of these Terms, this Section 28 governs for App Store downloads.

28.1 Acknowledgement. You acknowledge that these Terms are concluded between you and easyDacha C-Corp only, and not with Apple Inc. ("Apple"). easyDacha, not Apple, is solely responsible for the easyDacha application and its content.

28.2 Scope of License. The license granted to you for the easyDacha application is limited to a non-transferable license to use the application on any Apple-branded device that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that the easyDacha application may also be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing.

28.3 Maintenance and Support. easyDacha is solely responsible for providing any maintenance and support services with respect to the application, as specified in these Terms or as required under applicable law. Apple has no obligation whatsoever to furnish any maintenance and support services.

28.4 Warranty. easyDacha is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the application (if any) to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the sole responsibility of easyDacha.

28.5 Product Claims. easyDacha, not Apple, is responsible for addressing any claims by you or any third party relating to the application or your possession and/or use of it, including but not limited to: (i) product liability claims; (ii) any claim that the application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

28.6 Intellectual Property Rights. In the event of any third-party claim that the application or your possession and use of the application infringes that third party's intellectual property rights, easyDacha, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

28.7 Legal Compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

28.9 Third-Party Terms of Agreement. You must comply with applicable third-party terms of agreement when using the easyDacha application.

28.10 Third-Party Beneficiary. You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
