About This Document These Terms and Conditions (“Terms”) govern your use of the easyDacha mobile application and related services (“Service”) provided by easyDacha C-Corp (“easyDacha,” “we,” “us,” or “our”). By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not download or use the Service. These Terms, together with our Privacy Policy, constitute the entire agreement between you and easyDacha. |
How We May Use Your Plant Submissions If your User-Added Plant entry — including photos and descriptions — meets our quality standards, easyDacha may select it for inclusion in the easyDacha Shared Plant Library, where it becomes available to all users of the Service. By submitting a User-Added Plant with photos, you grant easyDacha a perpetual, worldwide, royalty-free, sublicensable license to use, reproduce, display, and distribute your plant photos and descriptions within the Service and in any future version of the Service. This license continues even if you later delete your account, for any content that has been selected for and remains in the Shared Plant Library. We will display this notice clearly at the point of upload within the App. |
Your Right as an Early Adopter Users who created an easyDacha account before the date the Service was made publicly available on the Apple App Store or Google Play (“General Availability Date”) are entitled to one (1) full year of Full access at no charge (“Early Adopter Benefit”). The Early Adopter Benefit period begins on your account creation date and expires one (1) year after that date. This is a binding commitment by easyDacha and may not be revoked or modified retroactively for qualifying users. |

You Can Opt Out of Arbitration You may opt out of this arbitration agreement by sending written notice to [email protected] within 30 days of first creating your account. Your notice must include: your full name, the email address associated with your account, and a clear statement that you elect to opt out of binding arbitration. Opting out does not affect your right to use the Service or any other Terms. If you do not opt out within 30 days, you agree to resolve disputes through arbitration as described in this Section. |
California Residents — McGill Rule Notice Nothing in these Terms prevents you from seeking public injunctive relief in a court of law as permitted under California law (McGill v. Citibank, N.A., 2 Cal. 5th 945 (2017)). Any claim for public injunctive relief that cannot be arbitrated will be stayed pending resolution of all arbitrable claims. |
